BaseRentIQ output is an estimate — not a legal opinion.

BaseRentIQ is an automated due-diligence aid. Its figures — reconstructed lawful rents, overcharge exposure, back-rent and treble estimates, deregulation flags, and improvement-cost (IAI) amounts — are preliminary estimates generated by software from incomplete public data. They are not legal advice, a rent-regulation determination, an appraisal, or a guarantee of any outcome, and they must not be the sole basis for any purchase, price, financing, litigation, or other decision.

What the numbers assume

The audit is built on the DHCR registration record and public data as provided. Those records may be incomplete, mis-filed, mis-transcribed at the source, or unlawful in ways not visible on their face, and a registration on file does not prove that the underlying filing, rent, lease, or service on the tenant was proper or lawful. Automated extraction can also misread a document. Key estimates (for example, overcharge back-rent) are computed as a constant-rate minimum over the statutory recovery period and the true figure is frequently higher once market rents compound; other estimates use the statutory minimum thresholds and standard allowances, not the actual registered figures where those are absent.

Rent-regulation questions are legal questions

Whether a unit is rent-stabilized, what its lawful rent is, whether a deregulation was valid, whether a J-51 or high-rent vacancy basis holds, and whether an overcharge is owed or willful are fact-specific legal determinations. They depend on the complete rent history, leases, improvement documentation, tax-benefit history, and current law — and can ultimately be decided only by DHCR, a court, or qualified counsel. BaseRentIQ does not make these determinations and is not a substitute for them.
